Not Worth the Paper it’s Written On – Certificates of Title to be Abolished

The New South Wales Government has set 11 October 2021 as the date on which paper Certificates of Title (CT’s) are to be abolished.

The production of a physical CT has traditionally been essential in the registration of a mortgage or conveyance of Real Property Act land. However, come 11 October 2021 paper CT’s will have no legal effect.

The Real Property Amendment (Certificates of Title) Act 2021 is the legislation behind this progression to 100% eConveyancing in NSW.

Registrar General Jeremy Cox stated:

“eConveyancing is a secure system, with checks and balances to protect against fraud. Abolishing CTs removes the administrative burden for people to manage and locate it in an environment where all transactions are done electronically.

NSW is retiring redundant paper processes that have existed for over 150 years and embracing a digital future which is faster, more efficient and more accurate.

This is a big moment for all NSW landowners as a more efficient and secure land title system will generate greater efficiencies in the property and financial sector and support NSW’s economy.”

The Torrens Title Register will remain as the single informative source as to land ownership.
